These terms apply to the use of the website, customer portal, listings, purchase requests, reservations, sales, commission-sale services, delivery, export support, marina or port handover, warranty handling and related services provided by MotoComply ApS.
By using the website, submitting an inquiry, creating an account, requesting a reservation, making a payment, signing a document or completing a purchase, the customer agrees to these terms.
Specific written agreements, invoices, reservation terms, sales contracts, delivery terms, warranty terms, commission-sale agreements or handover documents may also apply. If specific written terms are agreed for a transaction, those terms will apply to that transaction.

MotoComply ApS works with motorcycles, trikes, quads/ATVs, scooters, powersports vehicles, boats, yachts and related services.
The company may provide or assist with:

- Survey or sea trial coordination where agreed
- Customer portal access
- Delivery coordination
- Export support where available
- Marina or port handover

The availability of each product or service depends on the product type, location, ownership status, documentation status, inspection status, payment status, customer location and written agreement.
3. Use of the Website
The website is provided for general information, vehicle and vessel listings, customer communication, purchase requests, account access, document support and related services.
Users must use the website lawfully and responsibly.
Users must not:
- Use the website for fraudulent, misleading or unlawful purposes
- Submit false, incomplete or unauthorized information
- Attempt to access another user’s account or data
- Copy, scrape, damage, overload or interfere with the website
- Upload malicious files, viruses or harmful code
- Misuse contact forms, customer portal functions or document upload areas
- Attempt to bypass security, verification or payment procedures

4. Website Information
MotoComply ApS aims to keep website content, listings, prices, descriptions, photos, videos, documents and availability information accurate and up to date.
However, website information may be subject to change, correction, verification, prior sale, owner confirmation, supplier confirmation, inspection results, documentation review or final written agreement.
A vehicle or vessel is not considered reserved, sold or guaranteed available only because it appears on the website or because a customer has submitted an inquiry or purchase request.
5. Listings and Product Descriptions
Listings may include information such as make, model, year, mileage, engine hours, specifications, equipment, condition notes, photos, videos, documents, inspection information, location and price.
MotoComply ApS aims to describe vehicles and vessels clearly and professionally. However, listing information may be based on available documents, previous owners, suppliers, inspections, surveys, service records or third-party information.
Only information confirmed in writing by MotoComply ApS forms part of the final transaction.
The customer must review all available information and ask questions before submitting a purchase request, reservation request or payment.
6. Used Vehicles and Vessels
Used motorcycles, powersports vehicles, boats and yachts are sold according to their age, mileage, engine hours, condition, service history, previous use, inspection status and available documentation.
Used vehicles and vessels may show normal wear, cosmetic marks, age-related condition, corrosion, oxidation, marine wear, service needs, previous repairs, equipment ageing or other conditions expected from prior use.
Such conditions are not automatically considered faults if they are visible, disclosed, expected due to age or use, included in available condition information or reflected in the purchase price.
- Prices
Prices shown on the website are for customer guidance and may be subject to correction, currency changes, tax treatment, transport costs, documentation costs, export costs, marina costs, storage fees, registration-related costs, customs duties or other applicable charges.
Delivery, transport, export, customs, storage, registration, insurance, marina, harbour and port costs are not included unless expressly confirmed in writing.
MotoComply ApS reserves the right to correct obvious pricing errors, update prices, change availability or withdraw a listing before a transaction is confirmed.
8. Purchase Requests
Submitting an inquiry, purchase request or reservation request does not automatically create a binding sale.
A transaction is only confirmed when MotoComply ApS has accepted the request in writing and the required invoice, payment, deposit, agreement or reservation terms have been completed.
MotoComply ApS may refuse or cancel a purchase request if:
- The vehicle or vessel is no longer available
- Payment is not received on time
- Customer verification cannot be completed
- Required documents are missing
- Fraud or suspicious activity is suspected
- Export, delivery or registration requirements cannot be satisfied
- The transaction creates legal, financial or operational risk
- The listing contains an error or requires correction
9. Reservations and Deposits
Reservation and payment requirements depend on the product type, transaction value, documentation status, inspection status, delivery requirements and written agreement.
For motorcycles, trikes, quads/ATVs, scooters and other powersports vehicles, MotoComply ApS normally requires the full purchase amount before reservation, confirmation, handover or delivery begins.
For boats and yachts, MotoComply ApS may request a deposit of up to 50% of the purchase price, depending on the total amount, vessel type, documentation status, inspection status, survey requirements, delivery or port handover requirements and written terms agreed with the buyer.
A reservation is only valid when confirmed in writing by MotoComply ApS and when the required payment or deposit has been received.
Reservation conditions, deposit terms, payment deadlines, refund conditions and cancellation rules must be confirmed in writing for each transaction.
10. Payments and Invoices
Customers must follow the official payment instructions provided in writing by MotoComply ApS.
Payments should only be made to official payment details provided by MotoComply ApS.
The customer is responsible for checking invoice amounts, currency, payment references, payment deadlines and bank details before transferring funds.
MotoComply ApS is not responsible for delays caused by bank processing times, incorrect payment details entered by the customer, missing payment references, currency conversion issues, payment provider delays or third-party banking issues.
MotoComply ApS may withhold reservation confirmation, handover, delivery, export documents, ownership documents, keys or release instructions until required payment has been received and confirmed.
11. Fraud Prevention and Payment Security
MotoComply ApS may verify payments, customer identity, company details, source of funds, billing information, delivery information or transaction details where required for security, fraud prevention, anti-money-laundering risk control, export procedures or legal compliance.
MotoComply ApS may delay, suspend or cancel a transaction if payment appears suspicious, incomplete, unauthorized, inconsistent or high-risk.
Customers should contact MotoComply ApS directly if they receive suspicious payment instructions, changed bank details or unusual communication.
12. Customer Information
The customer must provide accurate, complete and up-to-date information.
This may include:
- Full legal name
- Address
- Email address
- Phone number
- Billing details
- Delivery details
- Identification documents, where required
- Company documents, where required
- VAT or registration information, where relevant
- Export or customs information, where relevant
- Authorized representative details, where relevant
MotoComply ApS is not responsible for delays, failed delivery, document issues or additional costs caused by incorrect, incomplete or late customer information.
- Documents
MotoComply ApS may handle documents connected to invoices, sales agreements, registration, ownership, export, customs, delivery, inspection, warranty, commission sale, identity verification, company verification and customer support.
Documents may be provided electronically, physically or through the customer portal, depending on the transaction.
The availability of original documents, manuals, service books, certificates, keys, accessories and historical records may vary, especially for used vehicles and vessels.
Only documents expressly confirmed in writing are included.
Documents may be withheld until payment, signing, verification, handover or transaction conditions have been completed.
14. Customer Portal
The customer portal may be used for account access, purchase requests, reservation handling, document review, invoices, delivery updates, order information, warranty communication and customer support.
The customer is responsible for keeping login details secure and must not share account access with unauthorized persons.
MotoComply ApS may suspend or close portal access if misuse, fraud, security risk or breach of terms is suspected.
Information shown in the customer portal may be subject to change, correction, verification or final written agreement.
15. Inspection and Condition Information
MotoComply ApS may provide or coordinate condition information, inspection notes, photos, videos, service records, survey material or other available details for selected vehicles and vessels.
Condition information is provided to support transparency and customer decision-making.
Condition information does not replace the customer’s responsibility to review available material, ask questions and obtain independent advice or inspection where desired.
For boats and yachts, a professional survey or sea trial is only included where expressly agreed in writing.
16. Survey and Sea Trial for Boats and Yachts
A marine survey, sea trial, lift-out, haul-out, crane service, underwater inspection or hull inspection below the waterline is not included unless expressly agreed in writing.
Survey and sea trial availability may depend on weather, sea conditions, marina access, port rules, surveyor availability, skipper availability, fuel, insurance, vessel readiness, payment status and written agreement.
Surveyor findings, inspection reports and technical assessments may be provided by independent third parties. MotoComply ApS is not responsible for independent survey conclusions, missed observations or third-party limitations, except where liability cannot legally be excluded.
17. Delivery and Handover
Delivery, transport, export support and handover may be available depending on the product type, customer location, transport provider availability, payment status, document completion and written agreement.
Delivery may include:
- Customer pickup
- Local delivery
- National delivery
- International transport coordination
- Covered vehicle transport
- Trailer transport
- Specialist vehicle or vessel transport
- Marina handover
- Port handover
- Export support where available
Delivery is not automatically included unless expressly confirmed in writing.
Estimated delivery or handover times are not guaranteed unless expressly confirmed in writing.
18. Marina and Port Handover
For boats and yachts, handover may take place at a marina, harbour, port, boatyard, storage yard or other agreed marine facility.
Marine handover may include vessel identification, payment confirmation, document review, key handover, access handover, equipment confirmation, visual condition check and handover signature.
The customer or authorized representative should inspect the vessel at handover and report visible damage, missing items or concerns immediately.
Marina, harbour, port, storage, crane, lifting, launch, haul-out, cleaning, fuel, winterization, electricity, water, security, access or handling fees may apply and are not included unless expressly confirmed in writing.
19. Risk Transfer
Risk transfers according to the written agreement, delivery method, handover terms and applicable law.
Unless otherwise required by mandatory law or agreed in writing, responsibility may transfer when the vehicle or vessel is handed over to the customer, the customer’s representative, transport provider, marina, harbour, port, storage facility, skipper or other agreed third party.
After risk transfer, the customer is responsible for insurance, storage, mooring, registration, maintenance, safe use, transport, import compliance and local legal requirements.
20. International Sales and Export
MotoComply ApS may serve customers in Denmark and internationally.
International customers are responsible for checking local import rules, customs duties, VAT, taxes, registration, certification, insurance, inspection and legal use requirements before purchase unless otherwise agreed in writing.
MotoComply ApS may assist with available export-related documentation where agreed, but does not guarantee that a vehicle or vessel can be imported, registered, insured or used in every country.
The customer is responsible for local duties, taxes, customs clearance, registration, inspection, certification, insurance and compliance in the destination country unless otherwise agreed in writing.
21. Right of Withdrawal and Cancellations
Consumer rights may vary depending on whether the customer is a consumer or business customer, whether the purchase is completed online, at a distance, in person, by special order, by commission-sale structure or under another transaction model.
Where a statutory right of withdrawal applies, MotoComply ApS will handle the request according to applicable law.
Where no statutory right of withdrawal applies, cancellations are only accepted according to the written agreement, reservation terms, invoice terms or applicable mandatory law.
Deposits, reservation payments, transport costs, document costs, marina fees, third-party costs, custom preparation costs or special-order costs may be non-refundable where permitted by law and where confirmed in the written terms.
No cancellation or withdrawal removes the customer’s responsibility for costs already incurred where such costs are legally chargeable and agreed in writing.
22. Business Customers
Where the customer acts as a business, company, trader, reseller, professional buyer or commercial operator, different legal rules may apply.
Business-to-business transactions may be subject to specific written terms, limited warranty, export terms, invoice conditions and professional buyer responsibilities.
Business customers are responsible for checking product suitability, documentation, import rules, tax treatment, resale rules, registration requirements and commercial use requirements before purchase.
23. Consumer Rights
Nothing in these terms limits mandatory consumer rights, statutory rights or legal protections that cannot be excluded under applicable law.
For consumer purchases where Danish or EU consumer law applies, customers may have statutory rights relating to faulty goods, lack of conformity, complaint handling, withdrawal rights or other mandatory protections.
Any commercial warranty offered by MotoComply ApS is additional to mandatory legal rights and does not replace them.
24. Warranty and After-Sales Support
Any warranty, guarantee or after-sales support depends on the product type, age, mileage, engine hours, condition, inspection status, transaction type, written sales agreement and applicable law.
No commercial warranty applies unless it is confirmed in writing by MotoComply ApS.
For eligible motorcycles, trikes, quads/ATVs, scooters and powersports vehicles, MotoComply ApS may provide a limited dealer warranty for a period of up to 3 months or 1,000 km from delivery, whichever comes first, unless another period is stated in writing.
For eligible boats and yachts, MotoComply ApS may provide a limited dealer warranty for a period of up to 30 days or 20 engine hours from handover, whichever comes first, unless another period is stated in writing.
Warranty claims must be submitted in writing and may require photos, video, diagnostic reports, surveyor reports, workshop assessments, mileage, engine hours or service documentation.
Repairs must not be started under warranty without prior written approval from MotoComply ApS, unless otherwise required by mandatory law.
25. What Is Not Normally Covered by Warranty
Unless otherwise agreed in writing, commercial warranty does not normally cover:
- Normal wear and tear
- Tyres, brakes, chains, belts, bearings, filters, fluids and service items
- Batteries and consumable electrical components
- Cosmetic marks, paint, upholstery, gelcoat, canvas, covers or trim
- Corrosion, oxidation, saltwater damage or environmental deterioration
- Damage caused by misuse, racing, overloading, neglect or lack of maintenance
- Damage caused by accident, grounding, impact, fire, theft, vandalism or weather
- Faults caused by unauthorized repair or modification
- Software updates, navigation systems, entertainment systems or third-party electronics unless expressly covered
- Transport damage after handover, unless MotoComply ApS accepted responsibility in writing
- Fuel, storage, harbour fees, marina fees, travel, accommodation, towing, recovery or loss of use
- Commercial loss, loss of income or indirect damages
26. Commission-Sale Vehicles and Vessels
MotoComply ApS may represent selected motorcycles, powersports vehicles, boats or yachts on a commission-sale basis.
Commission-sale representation may include listing preparation, customer communication, document review, inquiry handling, purchase support, delivery coordination and handover support according to written terms.
For commission-sale vehicles or vessels, warranty, liability and seller responsibility depend on the written sales structure.
No warranty is provided on commission-sale vehicles or vessels unless expressly confirmed in writing.
MotoComply ApS may refuse commission-sale representation if ownership, condition, documentation or transaction risk is not suitable.
27. Customer Responsibilities
The customer is responsible for:
- Reviewing available information before purchase
- Asking questions before payment
- Providing accurate contact, billing and delivery information
- Providing valid documents where requested
- Checking local import, registration and insurance requirements
- Paying agreed amounts on time
- Reviewing invoices and agreements before payment
- Attending agreed inspection, survey, sea trial, delivery or handover appointments
- Inspecting the vehicle or vessel at handover
- Reporting visible damage or missing items promptly
- Maintaining and insuring the vehicle or vessel after handover
- Using the vehicle or vessel lawfully and safely
Failure to provide required information, documents or payment may result in delay, suspension or cancellation according to the written terms.
28. Third-Party Services
MotoComply ApS may work with third-party providers such as transport companies, marinas, ports, customs agents, surveyors, inspectors, workshops, payment providers, hosting providers, insurance providers, financing providers, IT providers and public authorities.
Third-party providers may have their own terms, prices, processing times, schedules, insurance limits and liability rules.
MotoComply ApS is not responsible for third-party delays, charges, decisions, restrictions, service failures, document rejections or inspection conclusions outside its reasonable control, except where liability cannot legally be limited.
29. Website Availability
MotoComply ApS aims to keep the website and customer portal available, secure and functional.
However, access may be interrupted due to maintenance, updates, technical issues, hosting provider issues, security measures, internet disruptions or events outside reasonable control.
MotoComply ApS may update, change, suspend or remove website or portal features at any time.
30. Intellectual Property
Website content, text, structure, design, images, graphics, logos, documents, listings and other materials may be protected by intellectual property rights.
Users may view and use website content for personal or transaction-related purposes.
Content must not be copied, reproduced, distributed, modified, published or used commercially without written permission from MotoComply ApS, except where permitted by law.
31. Personal Data and Cookies
Personal data is processed in accordance with applicable data protection law and the Privacy Policy.
Cookies and similar technologies are used according to the Cookie Policy.
Customers should review the Privacy Policy and Cookie Policy to understand how personal data, account information, transaction data, communication records, uploaded documents, cookies and technical data may be processed.
32. Force Majeure
MotoComply ApS is not responsible for failure or delay caused by circumstances outside its reasonable control.
Such circumstances may include extreme weather, fire, flood, war, civil unrest, strike, labour dispute, pandemic, port closure, marina closure, customs delay, transport disruption, supplier delay, technical outage, internet failure, payment system failure, authority decision, legal restriction or other events beyond reasonable control.
33. Limitation of Liability
MotoComply ApS aims to provide accurate information, professional service and clear communication.
However, MotoComply ApS is not liable for indirect loss, loss of profit, loss of business, loss of income, loss of use, travel expenses, accommodation costs, missed delivery, missed season use, import delay, registration delay, website interruption, third-party delay, document rejection or other consequential loss, except where liability cannot legally be limited.
Nothing in these terms limits liability for fraud, intentional misconduct, mandatory consumer rights or rights that cannot legally be excluded.
- Indemnity
Where permitted by law, the customer agrees to compensate MotoComply ApS for losses, claims, costs or expenses caused by the customer’s false information, unlawful use of the website, breach of these terms, payment fraud, document fraud, unauthorized account use, misuse of a vehicle or vessel after handover, or breach of import, registration, tax, insurance or legal requirements.
This section does not limit mandatory consumer rights.
35. Changes to These Terms
MotoComply ApS may update these terms from time to time to reflect changes in services, website functionality, legal requirements, transaction processes, documentation procedures, delivery arrangements or business operations.
The latest version should always be available on the website.
Continued use of the website, customer portal or services after updates means that the user accepts the updated terms, unless mandatory law provides otherwise.
- Severability
If any part of these terms is found to be invalid, unlawful or unenforceable, the remaining parts will continue to apply.
The invalid or unenforceable part will be replaced or interpreted in a way that most closely reflects the original purpose, where legally possible.
37. Governing Law and Disputes
Unless mandatory consumer protection rules require otherwise, these terms and the use of the website, customer portal and services are governed by Danish law.
Any dispute should first be attempted resolved through direct communication with MotoComply ApS.
If a dispute cannot be resolved amicably, it may be handled by the competent courts or authorities according to applicable law.
